Challengers of public managers: debates in Brazil

The 3rd Meeting for Mayors Elected in 2013, organized by the Association of Municipalities of the State of Rio de Janeiro (AEMERJ), will be hold on March 14th and 15th at the Blue Tree Park Beach Resort Buzios in Buzios, at the coastal region. The event will gather the mayors elected in October 2012 from the municipalities of the state of Rio de Janeiro. Due to the current laws regarding administration probity, personal liability of public managers and its traps, many of these elected mayors may be at risk of not being eligible for re-election in 2016, even if doing a good job during their term of office.

The agenda focuses on essential issues for the new managers in the state, as Planning, Sustainability and Opportunity, the event offers special space for the exchange of information between the local leaders, space for the strengthening of proposals and commitments, as well as the term early planning and the joint creation of strategies.

To the jurist Fabio Osorio Medina, author of “Theory of Administrative Improbity” – and one of the guest speakers, a new challenge to public managers who were assigned in the municipalities is precisely the evaluation of risk scenarios and the juridical grounds of the public decisions.

“It is a delicate context that public officials currently face in the municipal administration. Therefore, one should take all precautions to prevent the occurrence of situations which may give rise to risks of administrative misconduct. The acquaintance with all legislation permeating the public decisions is an inevitable path, in the light of the rational grounds of these decisions. The Law of Impropriety dialogues with the Law of Fiscal Responsibility, urban planning and environmental law, legislation regarding public budget, and the whole legislative universe guiding the actions of public officials”, considers the jurist, noting that “the role of the lawyer receives peculiar importance as source of guidance for those who want to prevent problems”. “To maintain a proper dialogue with the authorities and with the municipality prosecutors is another major challenge for the new public managers”, he ponders.
