Federal Supreme Court should resume judgment on retroactivity in the new Administrative Improbity Law. Read Medina Osório's opinion
The judgment by the Plenary of the Federal Supreme Court (STF) on the retroactivity of the more beneficial rules of the new Administrative Improbity Law is due to resume this week. The judgment began last week, with the votes of Justices Alexandre de Moraes (rapporteur) and André Mendonça. I have maintained that the retroactivity of the new LIA with respect to its more beneficial rules is consistent with the constitutional principles of administrative sanctioning law, a position shared by the Federal Council of the OAB, admitted as amicus curiae in the judgment.
