NOTE OF MOURNING: JUSTICE SEPÚLVEDA PERTENCE (1937-2023)
Translated from the original.
I wish to record my deep sadness at the passing of retired STF Justice José Paulo Sepúlveda Pertence, which occurred in the early hours of Sunday (2/7) in Brasília (DF). Sepúlveda Pertence, a native of Sabará, Minas Gerais, was a Justice of the Supreme Court from 1989 to 2007. Justice Sepúlveda Pertence also had a distinguished performance as president of the Superior Electoral Court on two occasions: between 1993 and 1994, when he presided over the Electoral Court during the presidential elections, and between 2003 and 2005.
An alumnus of the Public Prosecution Service, from which he was arbitrarily removed under AI-5, he set up a law firm alongside Justice Victor Nunes Leal, who had also been arbitrarily removed. Attorney General of the Republic under the Sarney government, he was one of the members of the Affonso Arinos Commission, which drafted the Constitutional Preliminary Draft for the 1988 Brazilian Constitution. The proposal for the autonomy of the Public Prosecution Service was Sepúlveda Pertence's suggestion.
He was a unanimous figure as a jurist and as a human being. Justice Sepúlveda Pertence had been a widower since 2016, when he lost his wife, Mrs. Suely. I wish to express my solidarity with the children and grandchildren of this great man of the Law whom Brazil has lost.
